Parental Responsibility
When a married couple separate, both mother and father have parental responsibility. If they are unmarried, only the mother has automatic rights in respect of the child, so if they break up, she has the sole right to look after her child in a manner and place as she sees fit.
Since 2002, an unmarried father can also acquire parental responsibility if he jointly registers the child’s birth with the mother. He can also get parental responsibility if both partners sign a Parental Responsibility Agreement. This can be done at any time during the relationship or separation and can also be ordered by a court during or after the separation process.
Whether or not the father has parental responsibility, he is still responsible for the financial support of his children. He can be contacted by the Child Support Agency for this money.
Deciding Residency
One of the forms usually presented at court along with a divorce petition is a Statement of Arrangements, which proposes where and with whom the children will live, schools they will attend, who looks after them and how often they see the other parent.
The divorce petitioner should, as a matter of good practise, present the statement to the other parent for agreement before it is submitted. Courts encourage the parents to reach an agreement without them having to get involved. If you are having trouble reaching an agreement, it may be worth seeing a mediator before you divorce.
Mediators can be very helpful resolving sensitive issues like where your children will live. They provide an organised and constructive environment in which you can look at all the possible options and concerns and decide which is the most beneficial for your children and you. They have a good track record in helping children maintain family relationships. Mediation can be free depending on your circumstances.
At the start of divorce proceedings, the court will set up a conciliation appointment. If this does not result in agreement, the court will get both you and your partner to talk to a CAFCASS officer, from the Children and Family Court Advisory and Support Services. If an agreement still cannot be reached, the officer you see will take statements and make a recommendation to the court.
It is important to co-operate with the CAFCASS officer as their opinion is very influential to the court’s decision.

How the Courts Decide
In the 1989 Children’s Act, it states that when the court makes any decision about a child, the child’s welfare must be the court’s ‘paramount consideration’. There is a list of key factors they take into account when making their decision:
- Your child’s wishes and feelings. These will be given more consideration the older the child is.
- Your child’s physical, emotional and educational needs. This covers both love & affection and food & housing.
- The likely effect of a change of circumstances on your child. Their greatest concern here will be causing minimum disturbance to the child.
- Your child’s age, sex and background. This could include cultural, religious or disability needs.
- If your child has suffered harm or is at risk of suffering harm. Recently, this also includes any domestic abuse the child has seen or heard.
- The parents’ capabilities with regard to the child’s needs. This can include assessing whether the non-resident parent is capable of caring for the child. Or whether either parent is impaired by drink or drugs.
- The range of powers available to the court. There are a range of orders a court can make. Sometimes they decide no order is necessary.
Me and my husband seperated when I was 2 months pregnant. Ive been living with my parents and will stay here for support. He lived abroad for work and refused to return back to the UK using "saving up" as an excuse and returned back a week before I gave birth but we still lived separate. He lives with his parents now. He has never attended any appointments regarding my pregnancy or antenal classes. He came to visit the baby 4 times in the first 4 weeks and then he came 5 weeks after that once to see him. Basically it's not been consistent his visits. He hasn't done anything for the baby.hasnt bathed, fed or changed him. He just comes for an hour, holds him then leaves. He only provides child maintenance. But before child was born he was giving me personal allowance more money before baby was born and tben he reduced the money once baby was born without giving an explanation as to why he reduced it.
He is now threatening me and his family that they are going to fight for full custody of the child if I divorce him. I wanted to know what are the chances of him gaining the custody. He also lives in London wirh his parents whereas me and baby live up north in Manchester. I have been the babies caregiver since birth who is now 9 weeks old. I've taken him to all his appointments kept up to date with everything and also take him to sensory classes to encourage his development as a plus. Would he still have high chances of getting custody or will I. Please can you let me know. Much appreciated, thanks.

I am a French man married to a Japanese woman, we have 1 son of 5 years old. We live in the UK since May.
My wife already tried to stab me with kitchen knives when we were in Japan, 3 years ago. At that time our son was taken away from us to protect him from her hysterical behavior, but as you imagine I was not in the position of asking for my child's residence with me as foreigner are not prioritized in Japan. I then worked out politically with my wife to have our son back hoping she would behave better from that point.
Now our son is at school in the UK, she mentally harass him during his homework and he is loosing confidence in himself. After her verbal abuse, she often comes to me and start the same mental abuse shouting and recently she is starting to physically attack me (Strangulation, or she tries to take a knife the same way as back in Japan. I now succeed in preventing her to access the knives during her hysterical phases).
I am extremely worried for the next few months as these phases are more and more frequent. I seriously plan to divorce, but I can't give up the thought that I need to keep my child with me and protect him. If she knows I think of divorce, there is an extremely high risk that she will abduct our son and take him back to Japan. I definitely want to avoid this.
In order to safely enter the divorce procedure, I want to make sure that my wife can't take our son wherever she likes, to protect him, and make sure that I have some kind of nanny to take my son to school in the morning and back from it until I come back home from work, for when my wife leaves the house.
This process seems emotionally and physically very hard to put in place, so I would like to kindly ask you advise on how to proceed as I feel I am falling apart after all the attacks she performs on my son and I.

I’m about to move to be closer to my family and get more support. He has said he wants to see our baby through a mediation centre until he has completed his PhD (baby will be around 4 or 5 years old) studies before taking me to court to get full access to our child so he can take him to live out of the country. He has barely spent any time with the baby, demanded I paid for a dna test to prove he was the father, has t helped me with him, doesn’t change him or feed him and as soon as he cry’s he can’t cope and gives him back to me.
I’m so scared about losing my child and him taking him out of the country. Especially as he will barely know him as visits between now and him completing his studies will be sporadic due to how busy he will be. Is there anything I can do?
My ex has been a absolute nightmare since I became pregnant with my first child. He has made social services come into our lives over his lies and that was proven.

Withhold temper he doesn't know what he is doing when he goes into a rage. Because of this I've banned him from seeing us. The police told me to do exactly that. If it goes to court will he be allowed access or will he lose all rights? We were never married
Went to mediation and agreed to make child arrangements between us. He saw our daughter for a good 2 months with regular payment. Last 2 times he has messed about with payments (so the last time she didn't go wth him as he was being verbually abusive in front of our child) and messing around with the times he's collecting her. He now wants to go for joint custody. I am willing for him to have her every Tuesday overnight or for dinner and every Saturday but he's still wants to go for joint custody.
What are the chances he would get it?

...if that changes from Mother having just one weekend in two plus every Wednesday after school and overnight to, at her request, 50 50 share
...does the father then have to start paying child support?
His eldest son is wanting to live with him at 13 or stay as much as possible. If this is more than the 50 50 agreement, how would that work?
Me and my wife , had a lot of problems in the past because her family and her problem with alcohool. I want to say I never been a fan of alcohool and quit smoking a few months ago. From the moment i quit smoking she start to be more agresive and she start drinking every weekend and even during the week. i was working most of the time and i can understand how hard is to be looking after two boys at once, but almost every day i was cleening the house, feed my kids, change their nappies, bath them. A couple of weeks ago, one of her sisters who was the nanny of my kids, decided to leave and my wife lost it from that time. i couldn`t get into the house without bringing the police. anyway, she ask the police to arest me because i assault her, or hit her. Police seid to her they cannot do that because she didnt had any marks on her body and i was the one with scratches on my hand, neck and head. i didnt report her, obviously. she is the mother of my kids. But now i`m struggling to see my kids. Iwent there and i left for my boys everything they needed(fresh fruits and vegetables, chicken, milk, nappies etc etc) I paid for the bills and she is forcing me to pay for everything( rent, pocket money for her , bills, food, clothes) I dont mind to pay everything for my kids. But i don`t have the obligation to give her money for her needs. i dont want to say anything about what kind of person is she. I want to know if is a possibility to take my kids with me and take care of them. Now i`m not allow to see them, even we discuss to meet in a public place for her to feel comfortable. He makes her choose between going to parties and doing something “extra fun” with him and sometimes even refuses to let her go to a party.
He lives 90mins (without traffic) and two major A roads away from where she goes to school. What are the chances of him actually getting 50/50 custody? I don’t want her life turned upside down, and never being settled in a home, she’s a sensitive little soul and I can’t bear to watch her go throug this. Any advice appreciated.

The tenancy agreement of the house was my sons before he married he the had her name but on it how does he stand does the council have to rehouse him if the house is given to her as he has nowhere to live and the mother in law is getting a bit ott
My ex husband and I divorced 2 years ago - we went to mediation in July 2016 and agreed on shared care for our 2 year old son 50/50 split - 3 weeks later my ex told me he couldn't cope with our son and only wanted to see him on a Sunday 10-5pm - this has been happening for 1 year.
We went to mediation again today August 2017 I agreed with him alternate weekends but didn't agree with one night in the week due to our son being so young and in bed by 6.30/7pm. He wouldn't agree to that and has now told me he is taking me to court for 50/50 custody.
What are the chances of him getting this?
We both work full time, our son goes to pre school 2 days a week that is 5 minutes down the road from my house and to his maternal grandparents 3 days a week again 5 minutes away. My ex lives 30 mins away.

My partner and I have split up, we have 4 children from 12 years to 1 year. I still breastfeed my 1 year old and he has never spent a night away from me. My partner wants shared custody where he gets the kids either 3 nights in a row at a time or a week at a time.
I am a stay at home mom and he works long hours often not getting home in time for the kids bed time, my youngest relies on me to put him to sleep and wakes up for feeds during the night. Will he get 50/50 access granted to have the kids 3 nights to a week in a row at a time?

She is married to an English man, living here on a visa which expires in a year; in order to stay longer she will need a settlement visa. The husband wants a divorce, so this visa will clearly not happen, meaning she will return to Thailand.

The wife has no job, since she spends her time looking after the child.

Depression and has been in hospitalised 3 times. Her children are 3 years and 18 months and her husband was very supportive. Suddenly he told her he wanted a divorce. She is not allowed to be alone with the children due to her depression and she has a clinical coordinator who helps her and social workers who keep an eye on the Children. I live 4 hours away from her . She has no money , no friends and can't return to work yet. Her husband and his lawyer are putting pressure on her to move out of the house. Is there anything she can do as this is pushing her to the brink

My ex refuse to talk to me about arrangements for our daughter she is 10.
He left 18 months ago. Lives with another woman. During thise 18 months he see daughter 9 hrs a week.( 3 hrs /3 days) . During thise 18 months he has not once ask for her to spend one night at his place.
I also gave up.my full time job to get one to fit around our daughter so we could save in childcare. I drop/pick up from school everydays. I also fed her before she sees her dad.

To move who also mean a easier access to my family. Ues that would mean a change in the daus he sees he daughter at the mive would be a 2.5 hrs drives. But i am ready to me half way or even to bring daughter and i spend the night in a hotel.
Would there be problem? It is a thought and true the idea of having support near me at all time would be good to both of us.
I've now gone back to work and he's home with the kids. Even though he said he was going to look into night shift taxi driving, nothing has materialised and he doesn't seem to be looking for anything else. I pay the chunk of the bills, clothes and other bits for myself and kids. He pays utility and council tax. Although he's got a little saves he's demanding that I give him money for the bills debiting his account. He also likes to have digs at me for not saving or always wasting money etc even though whatever I spend money on is mostly for the kids and also I am coughing up for all of the expenses.
My biggest fear is that he will get custody of the kids as he's seen as the primary carer because they're home with him during the day.
I feel so heartbroken, he likes to taunt me about my parents divorce and wind me up to the point where I end up raising my voice when kids are about. I am so broken, the only reason I stay is because as far as I know he will get custody.

At the moment we are in a bad situation in our marriage.... How shall I start...I was working before got pregnant now looking back to go back to work. Our son is 15months old and things are not going well ... my husband is treatening to take our son away from me . He's saying that for the last year and a half he's the main money provider plus I'm not bread and born in England he's Irish and saying that the court won't leave our child with me because I'm foreigner. He is earning very good money that's the other thing so he constantly says that I have no chances if we go to court..

My question is this: he has threatened numerous times over the past month to take me to court for custody of them, he lives in Scotland and I live in Northern Ireland. I am on benefits now as a result of the separation and he has full time work but I have been the primary carer of both our children since day one. Is it likely that a court will award him custody of our children or even just of my son so they would be living in Scotland with him?

I basically want to leave as amicably as possible for our daughters sake but think my daughter would be better with me.

I have been married for 10 years but have never been happy in the marriage. I have 2 children and im considering getting a divorce. My husband usually illtreats me and we have no connection as a family.
Although I have been working all these years,I have been responsible for looking after the kids. I have taken a step back career wise as well so that i can look after the kids well. My ex is an ex alcoholic or still is I'm not 100% but sounds like it when she is on the phone, telling me my son hits her will not do as he is told, wetting the bed, and standing wetting himself, telling me to give him into trouble. This has gone on for sometime but has been constant now for 2 weeks with the phone call. My son of 3 years old, does have some accidents wetting the bed or himself to be honest bed wetting I think I have nailed that, I take my son before I go to bed and I have had 100% wet bed free for 2 month lol.
The problem I have is that my ex will say my son is not well, before I pick my son up. I say ok will I just leave it this weekend. Because when kids are not well they want mum I understand that children need both parents but mostly they want mum. This is what I get. How can you not look after him he is your son.
She never take my son for a weekend unless I have had to work away even then she asked me to take him to my mothers, I said no.
My son is happy with me I'm not just saying that.
When I take my son home it's like the happiest goes away from him every time we get to the motorway to his mum house.
As for hitting his mum she is phoning me and says he is hitting me now at 20:30 tonight.
My son goes to bed 19:30 in my house my son doesn't hit me or answer me back. I do get strops when he wants something he is not getting if he is bad I put him in time out sometimes he will not get out all day.
I have said to my ex I will take my son for 4 weeks to see if this can help, as much as I would love to keep my son full time, and maybe this is what my son wants.
I want to do something about this mess, my son is hurting and all I'm doing is trying not to hurt his mum by doing something and that I will probably not get to see my son every weekend for some time if I do something.
Sorry for going on but I really don't have anyone to talk to about this.

We have all heard the stories of a parent taking their child for the weekend and not returning them or going abroad with them and it becoming extremely difficult for the other parent to get their child back. Thankfully, this is one of the scenarios that a PSO seeks to prevent. The court would make an evidence-based decision upon what it thinks is in the best interests of your son.
My wife has decided to separate and divorce as soon as she finds a job.
But she clearly intends to go abroad at some stage.
I am worried she might get custody of our only son and if she goes back to Asia, I will not be able to see my son very often.
What does the law say in my case?
About 5 years ago my wife was diagnosed with fibromyalgia and her doctor has tried many different types of medication to help her to deal with this illness, but I am afraid that during the last 8 months we have been having the worst arguments about silly things. I know she is depressed and the medication does not help and I am convinced this is the reason behind our current situation, I care for her in every way. Cooking, cleaning, shopping, paying bills, helping her to dress and wash and bathe. I love her very much but she says I never show it and that I don't care anymore, and that she doesn't love me or want to be with me anymore. My youngest daughter wants to stay with me and the eldest wants to stay with mum, and I know that when I take her to school on Monday, my wife will be there with the in-laws to take her from me, neither my daughter nor myself want this but I don't want a confrontation outside school as this is not good for any of us especially my youngest daughter. I have not got any family to turn to for advice or support and I don't know what to do for the best. I still love my wife but she no longer wants to be with me, I am very worried as I know that she can't cope on her own never mind with two children and I do not want to leave her to cope on her own. I don't think this is really what she wants either but the drugs she is on make her confused and suicidal. What is the best way to deal with this as I don't want us to split, nor do I want to loose my children. I am at my wits end and I realise that if I am not wanted I will have to leave, but I don't want it to come to this. Please help us.
