Nobody says ‘I do’ thinking that their marriage won't last. However, it is a sad fact that a large number of marriages do fail, with current figures somewhere between 30 and 40 per cent.
When couples decide to divorce, there can often be bitter wrangling over the financial and proprietary aspects of the marriage.
Generally, if one person has control over the finances during the marriage, the other party will be at a considerable disadvantage when it comes to the divorce proceedings.
Every marriage concerns an element of interdependence but when a couple divorces there is a need to divide assets, money and other property. However, these are broadly divided into two categories, ‘marital’ and ‘non-marital’ assets.
What Are Marital and Non-Marital Assets?
If you have assets that you owned before the marriage, such as money or property that you have inherited, payouts from personal injury awards or other legal settlements, or gifts that you receive during the marriage that were not intended as ‘family’ gifts, these are non-marital assets.
For example, you as an individual inherit a painting that you then sell at auction. If you deposit the proceeds into a joint bank account, or spend some or all of the money on your spouse or joint assets, this property then becomes marital property. There are ways to identify and track liquidated non-marital assets, but these procedures are seldom straightforward.
How to Protect Your Assets
In order to protect your non-marital assets from being counted as marital, always remember to keep them separate. If you are not yet married, consider talking to your future spouse about the assets that you both have and what you both intend to keep as your own. Although it’s not exactly romantic, it can help to avoid considerable emotional wrangling and bitterness in the future if the marriage fails.

Stay Credit Worthy
Keeping your own assets separate in a marriage is particularly important if you are at a financial disadvantage, e.g. if you are not working, are working but earn considerably less than your spouse, or if you are at home caring for children. Some spouses, usually wives, can rely solely on their husband’s means all their married lives and when it comes to divorce they can discover that they are barely credit worthy.
As a result it is vitally important that you retain a good credit rating, so that if you find yourself single again you are able to support yourself and obtain credit from lending institutions. The easiest way to do this is to have a credit card in your sole name. However, it is equally important to maintain your payments on this account, as a bad credit rating is as bad, if not worse, than having no credit history at all. Also, make sure that you are named on all the household accounts.
Keep a Record
Although it may seem cynical, it is also wise to make sure you keep yourself up to date as to the extent of your and your spouse’s assets from time to time. Make sure you have copies of proof of ownership, as in the event of a divorce these can go ‘missing.’
Finally, if you are on the brink of divorcing your spouse, make sure that you close any joint accounts immediately. The last thing you want is to be subsidising your spouse (and perhaps directly or indirectly their legal fees) after you have separated.

My marriage has been rocky since a particular event and my husband is doing every trick to minimize what he has to pay out in case of a divorce. I have two kids and trying to work things out as their well being is paramount to me. He owns property abroad in Mauritius and has owned it pre-marriage . He has owned it for 20 years. There was never a financial settlement made when we divorced due to a negligent solicitor. The marriage only lasted 2 years. He has his own assets and also thieved 28K from our joint bank acc which I have never claimed. He has never claimed from me either. I'm now planning to move house and my solicitor sent me a client form. It is asking me if I married since purchasing my property. I have plus got divorced. In the absence of an agreement, will this prevent my solicitor and me from selling my home now? I dont want it all dragged up again. So I guess I'm asking if this will prevent me selling my home?
I took a small mortgage so that my husbands children could live with us which is in my name my account and I pay. He paid 500 as did I into joint every month to cover all other bills and food.
When we separated one of his children stayed with me and he does not pay me anything for her up keep.

His wife has not worked for over 12 years and does not contribute anything to the house or income but spends a thrifty amount on his credit cards every week. It’s sad to see because my dad has worked hard throughout his entire life and even though he is retired he is still working to fund her lifestyle. They have recently moved house in the last three years and this time he added her name to the mortgage, neither have any dependents. Is there anything he can do to protect his assets? Her and her two grown children take him for a mug and don’t deserve everything he has worked so hard for.
When I divorced my first husband I had the mortgage free house as settlement. I foolishly remarried and moved house, the house now is mortgage free but in joint names. Been together with my wife 9 years and married 5. She has a "normal" job.
I own a limited company.100% mine & set up before we were married.
I also have 4 rental properties, again all purchased by just me in my name and prior to our marriage. We live in our marital home which is join 50/50 owned.
Our marriage fell apart & i applied for the divorce. She is trying to make claim to my rental properties and limited company. (She's never even put 10p into any of them)
I am of course seeking formal advise but any informal advice in respect to what she will "likely" end up with or the way the situation will be viewed or any other advice will be most welcomed.

I am in a state of shock - my wife moved out and wants a divorce. The house is in my own name and was before we got married. She is not on the mortgage although was contributing towards the bills etc. Since our marriage 3.5 years ago, she sold her house and pocketed 30k from the proceeds. She has since also collected artwork to the value of 20k - this has been during our marriage. She has ISAs worth around 40k - again from money she inherited during the course of the marriage. They've worked out I get the savings and my pension (112k) she gets all the equity etc 230k. She can buy a house cash and I don't even have enough for a deposit but will still have to pay her CSA money as well.

I am going through a very difficult divorce, when we meet my ex husband was very heavily in debt, he went bankrupt for over £80,000, I remorgaged my house, that I have now owned in my sole name for 24 years, I bought his business took out loans in my name, nothing was in his name and he did not work and owned nothing. He started to take control of the business finances and would not let me have anything to do with them. we meet in 2008 he moved into my house in 2009 and we married in 2013, we divorced in 2016. I survived and I am now struggling financially, he broke into my business premises with his family and friends in late 2016, they stole a lot of equipment and assets, the police didn't and wont do anything, they say its a civil matter. I put over £150,000 into the business over the time I was building it up, he put nothing financially in. Does my wife have a claim on any money I make AFTER we separate but BEFORE we divorce? We have been married for 12 years, she earns less than me, will almost certainly get the 2 kids (though I am going to try for 50-50) so I expect her to get a larger share of our marital assets. Prior to marriage I had property as did she. When we started dating she bought property in France (she is a French national and has been living in the UK for a good 20 years) at the time she asked me if I wanted to be on the deeds I said no. I owned a large property in London and when we married we changed the deeds into both our names, and also put each other on the mortgage.
Throughout the duration of our marriage she has contributed £300 a month to living expenses and mortgage costs, which if you live in central London with a large mortgage, you'll realize this doesn't go very far!
Because there was so much equity built up in the property, I decided to purchase a second property, again, in both our names.
As the first property was mine prior to the marriage I want to fight for it, but feel comfortable with my wife taking half of the second property.
Obviously the best way to go about this is to get her to agree to another change in the title deeds and have her name removed, but if this isn't an option, what can I do?

She purchased the property when she was 18 and is now 58. He had been on the mortgage and they were married for 6 years prior to separation.
They had remortgaged the house during this time to clear his debts and her mortgage should be almost paid off by now.
Due to the remortgage she still has quite a long time left on her mortgage and not much equity. If she was to go through divorce proceedings again would he be entitled to half the equity even though he hasn't contributed anything in the past 10 years ? Or would this be reduced because of this?

Prior to the marriage my ex had 1 buy to let property which i have no interest in at all.
but i owned 4 buy to let properties prior to the marriage.
I appreciate the matrimonial home would need to be split between me and my ex but can my ex claim on my buy to let rental properties ?
During the marriage i kept all my finances seperate and we had no joint accounts or anything joint.
Out of that £20,000 I had to buy everything for my new rental property, wardrobes, beds, washing machine, sofas and furnish the new house as well as pay off remaining monies owed on the new kitchen we had fitted the previous year in our martrimonial home, an overdraft and the family car, in short I was left with very little of the £20,000.
He has since had me taken off the mortgage and threatened he'd make my life hell unless i Ageed To his settlement offer. I had no choice but to accept. I previously posted about my 5 week marriage ending. I understand that I can't file for divorce until I have been married for 1 year, and that it won't be finalised until the year after that, as we need to be living apart for 2 years. So basically, he's moving out today, how do I prove that when it comes to getting divorced? I'll be removing him from the council tax and electoral register from this address - is that proof enough? Also, as we haven't been married long, is there any way out of this quicker than waiting 2 years? I know getting annulled is out of the question. Thank you in advance.

I have lived in my council flat for 10 years, just me and my son. I met my husband 4 years ago and three years ago, he moved in and we got engaged and purchased the flat which was heavily discounted. Less than a year into the marriage he has been cheating so I'm now in the process of a divorce. He has admitted to adultery.
Since he has left nearly 6 months ago, he refuses to pay any money into the mortgage but has agreed to remove his name from the property and does not want any financial gain from it. Im currently putting together a consent order but I am worried the judge will tell me he is entitled to half or some of the property share. Will this be the case?
Please help me. I got married two months ago and now my husband wants a divorce as I questioned him about why he created online dating accounts when we were already boyfriend and girlfriend. I have £100k in the bank under my own name and I know my husband would want a share of that. I have that money in my account even before we got married. He has been putting in his wages to that account when we got married. Will he have a share of that whole money since it is the same account that he put his money in?
Also, I have golds that my parents gave to me even before we got married. Can he have a share of that too?

About 2 years ago, i moved in with my husband in his home, gave up my job and moved to his house. I have been living with him for 2 years now.

I have been married 10 years and now because of significant marital differences would like to get divorced. Neither my husband or I have worked during that time. We had enough assets to get through to retirement. Our marital home is in joint names though bought with my husbands money. Our life has been funded mostly although not wholely by his capital. He said the courts would award him this in the basis he put more in if he went to court. Please help as I thought by sharing an asset that is solely in my name I was already recognizing his contribution.
Im married with a joint mortgage & no children who is currently going through a divorce however my wife inherited from her parents 1/2 a house (other half was left to her aunt) aswel as some money. She inherited these items before submitting the divorce papers and therefore I would assume these should be split 50/50. Can you clarify on what grounds she could keep these inheritance assets? Currently her solicitors are stating these should not be taken into account yet it leaves her with an assets difference between myself and her of £95,000.
I moved into my wife's home, which she presented with a former partner , in 2010, we married in 2012, sadly due to her infidelities, we are to be divorced.

Can she transfer any marital or non marital property whilst there is difficulties in a marriage Whithout permisdion from the courts.
Further, her brothets lawyer acted for both of them. They are claiming yhey acted for the family? Should she have had seperate legal advice especially for conveyancing?
Has her brothers lawyers acted unethically especially as the transfer was to conceal assetts from her creditors.
She stopped paying morgage on marital home that led to me accruing arrears because I wouldnt sell our house to her brothef for under value. Her brother then ingluenced her to trsnsfer her property to him
This gets messy. Her brother then used leverage on aquired asset to buy a houdr for his brother in law who is illegally married in Uk and he had bedn claimjng rent from him for 5 years. Is this proceeds of crime? And money laundering.
My ex believes she and her family are scott free because of proof and as it occured jn 2008. Can her brother be made to transfer assett back??

Upon marriage we remortgaged to pay off her existing £20k debt and since that time we have also added further mortgages meaning that currently there is a £100k 10 year mortgage on the property (which is worth £240k) It the event of a divorce is this likely to be split equally or will the fact that I almost owned the house outright before we married be taken into account? I refurbished this property and sold it for a profit.
In Dec 2004 We agreed to buy a house together using some of my profits to fund the repairs. It was agreed between us that I would receive my investment and when we sold the property the profit after my return would be split 50% 50%.
We bought the house for £175,000 and it is now worth £195,000 ( due to property cash).
I raised the deposit and paid for the majority of the repairs approx. 90% we kept separate bank accounts during this process.
The Mortgage was paid jointly for six years until we split up due to irreconcilable differences in 2010. He moved out in March 2011.
He has not paid any of the mortgage since Dec 2010 and advised the mortgage lenders that he moved out in March 2010.
We have two children now aged 24 and 22 whom both live at home with me.
What sort of claim do you think he may have if any?

I need some advice. I'm trying to find a way to protect assets before marriage. Is there anyway assets can actually be protected? As a prenuptial agreement is not always taken into consideration in court. The property my partner owns is in his name and I am not on any deeds, so if we do get married, is his assets protected in anyway, or would the judge still see it as something to be divided equally in divorce? I owned my house 5 years before the marriage, 6 months before the end of our marriage I put my wife on the deeds and morgage. Having been divorce for 2 years now and since the time she left she has not paid any morgage payments and worse she cleared out our joint bank account and I had to pay back the massive overdraft she created.
She is demending half the equity of the home which is unreasonable since she has put no money towards the house. Can anybody give me some advice
